Each month we list only those agreement documents that have been updated. If a document does not appear below, no changes were made to that document in the stated month.

Updates July 2025

Pre-Release License Terms

  • Section 10: Deleted the section labeled "No Indemnity" and replaced it with "Defense of Third-Party Claims".
  • Section 12: Added: "This limit will not apply to the defense obligations in Section 10."

Updates June 2025

Pre-Release License Terms

  • Section 1: Added "technical preview" to the list describing pre-release software.
  • Section 4(a): Inserted the word "telemetry".
  • Section 4(b): Re-formatted the clause into a list and added a three-part entry clarifying ownership of inputs and outputs for AI services.

Updates March 2025

General Terms

  • Preamble: Clarified language for purchases made through partners.
  • Section 1.3 (Accounts): Added new sentences to cover cloud-based services and volume-based licenses.
  • Section 4.1 (NDA): Rewrote the section to clarify that a pre-existing NDA replaces the entirety of Section 4.
  • Section 11 (Definitions): Added new definitions for Controller, GDPR, and Processor.

Data Protection Agreement

  • Section 7 (Data Transfers): Added language to clarify data residency commitments for specific geographic areas.

  • Section 5 (Acceptable Use): Incorporated references to our new AI Code of Conduct.

  • Preamble: Expanded the second paragraph to identify the terms that apply to other products.

hexbyte Enterprise Cloud Product Specific Terms

  • Section 1 (Accounts): Added letters for each subsection for better organization.
  • Section 7 (Enterprise Managed Users): Added a new section for users of the EMU feature.
  • Section 8 (Definitions): Added new definitions for Enterprise Managed Users and Microsoft Product Terms.

hexbyte Copilot Product Specific Terms

  • Section 4 (Defense of Third Party Claims): Removed the requirement to have the Duplicate Detection filter configured to its [Blocked] setting.
  • Section 5 (Acceptable Use): Inserted "the AI Code of Conduct" and "the Required Mitigations".
  • Section 7 (Support): Added new section confirming entitlement to hexbyte's support services.
